Terms of Service

These terms apply when you order from Altered Us. Please read section 5 carefully — it covers the photographs you submit and the authorizations you must have before submitting them.

1. These terms and our other policies

Four documents govern your relationship with us, and each has its own job:

  • These Terms govern the purchase relationship.
  • The Privacy Policy governs our personal-data practices.
  • The Biometric Information Retention & Destruction Policy governs biometric retention and destruction.
  • The consent presented at upload governs the specific authorization you give at that time.

Where they address the same subject, the more specific document controls for that subject. Together they are the entire agreement between us regarding your order.

2. What we do

You submit one or more photographs and describe how you would like them transformed. A person at Altered Us reviews your request, uses an artificial-intelligence image model to generate artwork from your photographs, and sends it to you for approval. Once you approve it, we have it printed as a physical product and shipped to you.

Every order is reviewed by a person before anything is generated, and again before anything is shown to you.

3. Your account

You sign in with a link sent to your email address. Keep access to that inbox secure — anyone who can read your email can sign in to your account. You must be at least 18 to place an order.

4. Photographs, biometric information, and consent

Creating identity-preserving artwork requires analyzing facial characteristics in your photographs. Depending on the processing performed and applicable law, information derived from those characteristics may constitute biometric identifiers or biometric information. We obtain consent before any photograph is processed, and no photograph is processed without it.

Our retention and destruction schedule is published separately in our Biometric Information Retention & Destruction Policy. At upload you are asked to give three separate consents — currently consent policy version v2.0 — each of which you confirm individually:

  • Biometric consent. I authorize Altered Us to collect, use, store, and disclose biometric information derived from the photographs I submit for the purpose of creating and fulfilling my custom artwork order, as described in the Biometric Information Retention & Destruction Policy. I understand the purpose and retention period described in that policy and consent to the processing described there.
  • Your permissions. I represent that I have the rights and permissions necessary to submit these photographs and authorize Altered Us to process them as described above, including any permissions required for identifiable individuals appearing in the photographs. If this photograph contains an identifiable minor, I represent that I am the minor's parent or legal guardian, or that I have obtained authorization from the minor's parent or legal guardian sufficient to authorize the processing described in these Terms and the applicable consent notice. I am at least 18 years old.
  • Terms of Service. I agree to the Altered Us Terms of Service.

5. Your representations and warranties

The consent above is the authorization we rely on to process your submission. Separately, and as a contractual matter between you and us, you represent and warrant that:

You have obtained all permissions and authorizations required by applicable law from every identifiable person appearing in Submitted Content, or from their legally authorized representative, including any consent required for collection, processing, disclosure, or use of biometric identifiers or biometric information.

You further represent and warrant that you own, control, or have obtained sufficient rights to submit the photographs and to authorize us to process them as described — including with respect to copyright, privacy, rights of publicity, and, where applicable, trademark.

If a submitted photograph contains a minor, you represent that you are the minor's parent or legal guardian, or that you have obtained authorization from the parent or legal guardian sufficient under applicable law to submit the photograph and authorize the processing described at upload.

6. We do not verify your authority

We may rely on your representations regarding your authority to submit the content, but we are not required to independently verify your relationship to each person depicted. Submitting content you are not authorized to submit is a violation of these Terms.

7. The permission you give us

You grant Altered Us a limited, non-exclusive, revocable license to store your submitted photographs, transmit them to our contracted image-processing providers, generate artwork from them, display that artwork to you, create previews of it, and transmit the final artwork to our print providers — all solely to create and fulfil your order.

This license does not transfer ownership. You keep all rights you have in the photographs you submit. The license ends when the underlying content is deleted under our retention schedule, or when you cancel.

8. What we do not do with your content

We do not use submitted photographs or generated artwork to train artificial-intelligence models. We do not sell your content, and we do not use biometric information as an independent data asset.

We will not display your artwork publicly as an example of our work without asking you separately and explicitly. Ordering never implies that permission.

9. Requests from people appearing in submitted photographs

If someone appearing in a photograph you submitted contacts us about it, we will promptly review the request and, where appropriate, temporarily restrict further processing while we verify the request and determine what action applicable law requires. We may request information reasonably necessary to verify identity and authority. We may cancel an order in these circumstances.

10. What you may not ask for

You may not request, and we will not produce, artwork that:

  • reproduces specific elements of a copyrighted work — characters, costumes, logos, or distinctive settings. Working in the style of a genre is fine; reproducing recognisable protected elements is not;
  • depicts a real public figure, or anyone who has not authorized it as described in section 5;
  • is sexually explicit, hateful, harassing, or unlawful;
  • infringes anyone's intellectual property or right of publicity.

We review every request and every generated image, and may decline or cancel any order at our discretion. If we decline before production, you are refunded in full.

11. What AI-generated artwork can and cannot do

We use commercially reasonable efforts to produce artwork consistent with your request, but AI-generated artwork is inherently variable and cannot be guaranteed to reproduce every detail perfectly. Results can differ between attempts even from the same request.

This is why nothing is printed until you approve it, and why the revision process below exists — we will work with you through it to address material problems.

12. Approval and revisions

  • Nothing is printed until you approve your artwork.
  • You may request changes up to three times. If we still haven't got it right, a person will contact you to resolve it.
  • Because each item is made to order and personalised, production begins after your approval and cannot be undone once started.

13. Physical product quality

We treat two different situations differently:

  • Artistic dissatisfaction — if you do not like the artistic interpretation, that is what the revision process in section 12 is for, before anything is printed.
  • Manufacturing problems — if your order arrives damaged, defective, or is the wrong product, contact us and we will replace or refund it.

Minor variation between what you see on a screen and the printed product — particularly colour — is normal and is not a defect.

14. Prices, payment, and tax

Prices are shown before checkout and charged in US dollars. Payment is taken at checkout, before we begin work. Shipping and any applicable sales tax are calculated at checkout.

15. Shipping and delivery

We ship within the United States only. You are responsible for providing an accurate and complete shipping address. We are not responsible for orders delayed, lost, or returned because of an incorrect address you provided.

Delivery estimates are estimates, not guarantees. Carrier delays, weather, and similar events are outside our control. If a package is lost in transit, contact us and we will work with you on a replacement.

16. Cancellations and refunds

  • Before production: cancel from your account for a full refund. Your photographs and any generated artwork are deleted immediately.
  • After production has begun: the order can no longer be cancelled automatically, because a physical item is being made specifically for you. Contact us and we will work out a fair outcome.
  • Damaged, defective, or wrong product: contact us and we will replace or refund it.

17. Rights in the generated artwork

To the extent you own or are legally entitled to any rights in the generated artwork, those rights remain yours. Because copyright protection for AI-generated material varies by jurisdiction and depends on the degree of human authorship, Altered Us does not represent that every generated element is copyrightable.

We grant you a perpetual, non-exclusive license to use the artwork we deliver for personal purposes.

18. Your indemnity to us

You agree to indemnify and hold Altered Us harmless from claims, damages, and costs arising from:

  • copyright infringement;
  • right-of-publicity violations;
  • privacy violations;
  • lack of consent;
  • unauthorized submission of somebody else's image;
  • unlawful content;
  • violation of these Terms.

19. Limitation of liability

To the maximum extent permitted by law, Altered Us's aggregate liability arising from or relating to an order will not exceed the amount you paid for that order.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, and some states do not allow certain limitations — in which case the limitation applies only to the extent permitted.

20. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute not resolved informally will be brought in the state or federal courts located in New York.

If you have a problem, please contact us first — most issues are resolved quickly and informally, and we would rather fix something than argue about it.

21. Severability

If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.

22. Changes

We may change these Terms. If we make material changes we will update the version and effective date above, and material changes to what you consent to will be reflected in a new consent version at upload.
